Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

Este trabalho apresenta uma tradução, do grego, do capítulo primeiro da carta de Paulo, aos romanos, a partir do texto crítico de Westcott e Hort, de 1885, com uma significativa divergência, em relação às versões, em inglês, King James e NIV1, em português, ACRF2, ARIB3, Católica, NVI4 e Bíblia de Estudo de Genebra, e, em alemão, Luther. As razões dessa tradução estão comentadas em diversos temas, agrupados em quatro partes: Romanos 1:1-7, Romanos 1:8-14, Romanos 1:15-23 e Romanos 1:24-32. Esse (...) comentário é baseado numa breve contribuição do pensamento grego, do contexto de Habacuque, e numa interpretação tematicamente mais coesa que a apresentada pelo comentário de William Hendriksen. Esses temas, por sua vez, envolvem desde questões tradicionais, já bem conhecidas, como o serviço apostólico de Paulo, o nascimento de Jesus, bem como seu senhorio e filiação divina “em poder”, após a ressurreição, assim como a ideia do justo que vive pela fé, a justiça, a ira e a glória de Deus, assim como “novos” temas envolvendo a etnia cristã, o “batismo” final de Jesus, o conhecimento comum, a capacidade eterna, a atividade divina e a concessão de Deus, entre outros. Considerando as crianças como atores sociais (com voz e ação) competentes para a interpretação do contexto em que se inserem, apresenta-se no presente artigo uma reflexão sobre a sua importância, enquanto sujeitos e participantes na investigação partilhada. Através da participação das crianças como investigadoras em dois estudos de opinião, pretende-se discutir as respetivas possibilidades e limites, enquanto metodologia participativa na Educação Básica. A informação proveniente das crianças forneceu pistas de intervenção aplicadas à escola.

Este texto visa expor alguns conceitos próprios da doutrina do Direito de Kant, bem como os fundamentos a priori deduzidos pelo filósofo crítico nas suas obras Crítica da razão prática e Metafísica dos costumes – introdução à doutrina do direito, os quais devem ser encontrados na base de toda legislação prática. De posse de tais conceitos, investigo a possibilidade contemporânea de permanência da filosofia prática de Kant como supedâneo fundamental para uma política e legislação internacional para proteção e garantia dos (...) direitos humanos, e as condições exigidas por Kant para tal modelo legislativo. O principal objetivo deste artigo é realizar uma crítica ao argumento segundo o qual o princípio majoritário apresenta riscos à democracia, usualmente empregado pelos defensores da legitimidade democrática do controle jurisdicional de constitucionalidade das leis. Em uma sociedade democrática, onde os princípios da liberdade e da igualdade são adotados, o princípio majoritário fornece um critério justo para identificar os pontos de vista que devem prevalecer ao final de processos coletivos de tomada de decisão. As regras da unanimidade e da maioria (...) qualificada são insuficientes para corrigir as alegadas injustiças produzidas pelo princípio da maioria, em virtude das dificuldades de efetivação que possuem, da ausência de real proteção às minorias e das contradições internas que apresentam. Embora seja possível imaginar um sistema jurídico no qual o princípio majoritário viabilize a existência de uma tirania ou ditadura da maioria, presumir que, nesse contexto, os juízes necessariamente formarão o grupo de defensores dos direitos das minorias é realizar uma aplicação seletiva do princípio da igualdade. O artigo analisa poemas de Ricardo Domeneck, Eduardo Sterzi, Paulo Ferraz e Priscila Figueiredo, que tratam de questões sobre graves violações de direitos humanos cometidas pelo Estado brasileiro, como a memória dos desaparecidos ou das vítimas da ditadura militar. A análise enquadra-se no campo da literatura e justiça de transição, com o objetivo de estudar o cruzamento entre invenção literária e memória social, no tocante ao legado dos crimes contra a humanidade praticados pelo Estado brasileiro. Todos esses autores nasceram (...) nos anos 1970, durante a ditadura militar no Brasil, que durou de 1964 a 1985. Os poemas analisados foram escritos no século XXI, em um novo ciclo de memória cultural no Brasil, segundo a hipótese de Rebecca Atencio, no qual os temas ligados à ditadura voltaram a ser objeto da literatura brasileira com mais frequência. No caso de Paulo Ferraz, o poema diz respeito à Era Vargas (1930-1945). Domeneck, cujo poema é mencionado no relatório da Comissão Nacional da Verdade, e Sterzi referem-se à ditadura militar. Priscila Figueiredo trata das continuidades do passado autoritário nos crimes do Estado brasileiro após a democratização. Nesses quatro casos, a poética desses autores difere da que argentinos reunidos sob a categoria dos “hijos” têm estabelecido. (shrink)

Teorias científicas constroem um conjunto de argumentos para compreender fenômenos no mundo, compreendendo ações e elaborando prognósticos com base em conexões significativas. A partir do movimento de reflexão com epistemologias que questionam o projeto de ciência ocidental hegemônica com o objetivo de pensar o sentido da crítica na construção de antimonumentos da memória. A pesquisa será configurada da seguinte forma: quanto aos objetivos de caráter exploratório, utilizando como suporte teórico a investigação bibliográfica; quanto à natureza dos dados, a pesquisa configura-se (...) como qualitativa. O trabalho se apresenta a partir de um enfoque epistemológico e posicionado, refletindo a articulação entre a ciência/academia, a produção do conhecimento e a prática política. Tensiona os conceitos principais acerca de antimonumentos, teoria crítica e memória, além da contextualização de caso. Background Q-CEP (Qualificação dos Comitês de Ética em Pesquisa que compõem o Sistema CEP/Conep) is a nationwide project resulting from a partnership between the Brazilian National Research Ethics Commission (Conep), the Ministry of Health and Hospital Moinhos de Vento (HMV). It was developed to consolidate policy for ethical review of research with human beings in all members of the CEP/Conep System, Brazil’s national system of institutional review boards. The aim of this study was therefore to report on the experience and (...) results of the Q-CEP project. Methods An observational, retrospective study includes data from the Q-CEP, obtained from visits to all the institutional research ethics committees (RECs) in the country. The actions implemented by Q-CEP were part of a two-step process: (i) training visits to each REC; (ii) development of distance learning modules on strategic topics pertaining to research ethics evaluation. The data presented herein cover step one (training visits), defined by Q-CEP as the diagnostic stage of the project. For a country with social and economics inequalities such as Brazil, this is a particularly important stage; an accurate picture of reality is needed to inform planning of quality improvement strategies. Results In 2019–2021, Q-CEP visited 832 RECs and trained 11,197 people. This sample covered almost all active RECs in the country; only 4 (0.5%) were not evaluated. Of the 94 items evaluated, 62% did not reach the target of at least 80% compliance and around 1/4 (26%) were below 50% compliance. The diagnostic stage of the process revealed inadequacies on the part of the RECs in their ethical reviews. The analysis of informed consent forms showed compliance in only 131 RECs (15.74%). The description of pending issues made by RECs in their reports was compliant in 19.33% (n = 161). Administrative and operational aspects were also considered inadequate by more than half of the RECs. Conclusions Overall, Brazilian RECs showed poor compliance in several aspects of their operation, both in ethics evaluation and in other processes, which justifies additional training. The Q-CEP project is part of a quality improvement policy promoted by the Brazilian Ministry of Health. The data obtained in the diagnostic step of the project have contributed to the qualification and consolidation of one of the world’s largest research ethics evaluation systems. (shrink)

How should one describe the irreducible relationships in photopoetry observed in intermedial literary photobooks? According to most authors, in literary photobooks, the verbal sign system is linked to the photographic image as a bidirectional interaction, creating a coupled system that can be seen as a new sign system. Mutually modulatory influences link verbal text and photography. But the nature of such influences needs to be explained in detail and with accuracy. What kind of relation are we dealing with? Many authors (...) have tried to explain this phenomenon through several epistemic metaphors. The problem is that these metaphors are rarely subjected to any general theory of meaning. Surprisingly, this is not even mentioned as a problem. In this article, we propose a general semiotic model to describe the irreducible photography-poetry relation, derived from C. S. Peirce’s pragmatic theory of signs, and we also present some preliminary results of the analysis of Quarenta Clics em Curitiba, a photobook by Paulo Leminski and Jack Pires. Our purpose here is to introduce and explore this model to describe the photography-poetry relationship in coupled systems. This relationship is decomposed, in the functional roles occupied by poems and photographs, into a sign-object-interpretant relation. The triadic irreducibility that characterizes semiosis (à la Peirce) is the main property applied to photograph-poetry coupling in Quarenta Clics em Curitiba. (shrink)

O discurso didático que a escola vem construindo ao longo da história da educação brasileira tem em seu bojo o centralismo epistemológico eurocêntrico institucionalizado. Sendo assim, entendemos ser necessário a constante problematização em torno desses discursos na ação docente. Neste artigo, temos como objetivo analisar a forma como são discursivizadas a História e Cultura Afro-Brasileiras, Africanas, e Indígenas no discurso didático do livro de Física do Ensino Médio Integrado ao Técnico em uso no IFBA, campus Eunápolis. Realizamos uma pesquisa bibliográfica (...) por meio da análise de um corpus constituído de materialidades advindas da coleção, Compreendendo a Física, Alberto Gaspar – 3. ed. – São Paulo: Ática, 2016. Para isso mobilizamos a análise do discurso de linha francesa, as teorias fundantes desta pesquisa de perspectiva multicultural e decolonial, bem como discussões acerca do Livro Didático, esse aparato didático tão presente nas salas de aula e tão pouco consensual. Os resultados apontam que o discurso didático da coleção analisada, não se movimenta para a efetivação de fato da legislação específica do Ensino de História e Cultura Afro-brasileira na rede regular de educação básica. Por isso podemos afirmar que há necessidade de ampliação no plano conceitual e epistemológico do que significa construir uma proposta didática sob a perspectiva racial, que considere para o ensino de Física, as epistemologias africanas e indígenas que potencializam a descolonização deste artefato cultural. The aim of this study was to analyze the association between physical activity and eating habits during the COVID-19 pandemic among Brazilian adults. A sample of 1,929 participants answered an online survey, however 1,874 were included in the analysis. The impact of the COVID-19 pandemic on eating habits was assessed inquiring about participants' intake of fruits, vegetables, fried foods, and sweets during the pandemic. Physical activity was assessed by asking participants about their weekly frequency, intensity and number of minutes/hours engaging (...) in structured physical activities per week. Participants were then stratified into categories based on moderate-to-vigorous intensity and into active or inactive. Increased sweets consumption was the most commonly reported change to eating habits, followed by an increase in the consumption of vegetables, fruits, and fried foods. Physical activity practice was related to lower consumption of fried foods and sweets. A cluster analysis revealed subjects with higher the level of physical activity was more likely to follow a healthy diet. Thus, physical activity was positively associated with healthier eating habits. Health authorities must recommend regular physical as a strategy to improve overall health during the COVID-19 pandemic. Future studies should address the physical activity interventions to improve health status during a pandemic. (shrink)

BackgroundThe outbreak of novel coronavirus disease 2019 has caused a global panic and public concern due to its mortality ratio and lack of treatments/vaccines. Reduced levels of physical activity have been reported during the outbreak, affecting the normal daily pattern.ObjectiveTo investigate the relationship of physical activity level with sleep quality and the effects of reduction physical activity levels on sleep quality.MethodsA Google form was used to address personal information, COVID-19 personal care, physical activity, and mental health of 1,907 adult volunteers. Binary logistic regression was used to verify the association of physical activity parameters and sleep quality.ResultsInsufficient physical activity levels were a risk factor to have disturbed sleep pattern [OR: 1.28, 95% CI ]; however, when the BMI was added to the analysis, there was no more statistical difference [OR: 1.23, 95% CI ]. On the other hand, we found that the reduction of physical activity levels was associated with negative changes in sleep quality [OR: 1.73, 95% CI ], regardless all the confounders [OR: 1.30, 95% CI ], unless when feeling of depression was added in Model 6 [OR: 1.28, 95% CI ].ConclusionDisruption in daily physical activity routine, rather than physical activity level, negatively influences sleep quality during the COVID-19 quarantine. Um elemento nesta direção é representado pela sua visitação, a partir da virada para o século XIX, ao Louvre. Refletindo sobre sua experiência parisiense, o crítico formula a ideia de que a linguagem da pintura almeja uma universali- dade inimaginável no âmbito da política. In 1923, Sir Arthur Keith proposed that many common back problems are due to the stresses caused by our evolutionarily novel form of locomotion, bipedalism. In this article, we introduce an updated version of Keith’s hypothesis with a focus on acquired spinal conditions. We begin by outlining the main ways in which the human spine differs from those of our closest living relatives, the great apes. We then review evidence suggesting there is a link between spinal and vertebral shape on (...) the one hand and acquired spinal conditions on the other. Next, we discuss recent studies that not only indicate that two common acquired spinal conditions—intervertebral disc herniation and spondylolysis—are associated with vertebral shape, but also suggest that the pathology-prone vertebral shapes can be understood in terms of the shift from quadrupedalism to bipedalism in the course of human evolution. Subsequently, we place the aforementioned findings under an umbrella hypothesis, which we call the “Evolutionary Shape Hypothesis.” This hypothesis contends that individuals differ in their propensity to develop different acquired spinal conditions because of differences in vertebral shape that relate to the evolutionary history of our species. This article will discuss Paulo Freire’s global influences on environmental pedagogies and argue that ecopedagogical reinventions are essential for ‘quality’ education, as touted in the United Nations Sustainable Development Goal (SDG) #4, for global, all-inclusive ‘development’ that is planetarily sustainable. The politics of how ‘development’ is taught or not taught to be critically read linguistically and dialogically will be problematized through Freire’s work, and reinventions of his work, on ecopedagogy. As Freire was a pedagogue of critical literacy, ecopedagogical literacy (...) widens ‘reading the word to read the world’ (all humans, human populations) to read Earth to read the world as part of Earth. Such reading is not anthropocentric. The article will first describe Freire’s influence on reinventing environmental pedagogies, including education for (un)sustainable development (ESD), with specific discussions on how language of ‘development’ and corresponding (un)sustainability is framed. These influences from Freire will then be discussed through his de/re/constructions of citizenship, utopia and education, and globalization. Throughout the article, I will argue the need for teaching ecopedagogical literacy with ecolinguistics is essential to better understand the politics of language and (non)hierarchical dialogue which influence how ‘development’ goals are constructed, including the SDGs. Separated by two hundred sixty years, five thousand miles, and vast differences in cultural and linguistic context, these two incidents nonetheless share many traits in the conventional telling. Cortés and Cook (...) were both strong leaders, for instance, both capable of inspiring devotion among their subordinates. Both men became amateur ethnographers during their lengthy sojourns away from Europe, both sought to promote an image of respectful rather than rapacious foreign incursion, and both are said to have been taken for returning gods by the native peoples among whom they landed: Cortés for the Toltec culture-hero and demigod Quetzalcoatl, Cook for the Hawaiian deity Lono. Near the end of the popular 1983 film The Return of the Jedi, the forest-dwelling Ewoks begin to chant and salaam upon first glimpsing the golden robot C-3PO, who in turn tells his captured comrades, “I do believe they think I am some sort of god.” When Han Solo sarcastically asks the robot to use his “divine influence” to help extricate them from their predicament, C-3PO replies that such an action would be improper: “It’s against my programming to impersonate a deity.” Here we see, embedded within a film romance, both the classic trope of the apotheosized foreigner and the related motif of the foreigner’s reluctance to [End Page 406] play the god-role (see figure 2). It is worth noting, however, that while C-3PO may be unwilling to exploit the Ewoks’ misperception, Luke Skywalker is not; he uses the “Force” to convince the Ewoks of the robot’s magical prowess and, more to the point, to perpetuate their misapprehension. 5What I wish to suggest in this essay is that certain habitual Western assumptions or conceits regarding cross-cultural encounters—assumptions which have been usefully termed “myth models” inasmuch as they condition human perception and find frequent discursive expression—coexist easily but in fact disjunctively with certain other ideological structures in many early modern travel narratives and colonial accounts. This article delves into ecopedagogy, grounded in the work of the Brazilian pedagogue Paulo Freire on popular education and critical pedagogies, to teach students to critically deconstruct the subjectivity and transformability of our world (all humans, human populations) with the rest of Earth (i.e., rest of Nature). As Friere emphasized humans’ unique characteristic of ‘unfinishedness’ with abilities of self-reflexivity through our histories and goal-setting from our dreams, (environmental) pedagogues must teach toward deepened and widened understandings for praxis grounded in (...) socio-environmental justice and planetary sustainability, including disrupting anthropocentricism. This ‘unfinishedness’ has made humans agents of world-Earth unsustainably and dominance in constructing the Anthropocene, but also allows for possibilities of transformation to counter them. I argue that ecopedagogy is essential in disrupting the following falsely taught ideologies that justifies the Anthroposphere: (1) false commonsense that separates environmental and social violence (i.e., socio-environmental violence) and instills anthropocentrism that separates humans from the rest of Nature (i.e., world-Earth distancing); (2) fatalism that extinguishes hope of ending humans’ acts of unsustainable environmental violence; (3) ‘development’ for sustaining hegemony and planetary unsustainability (i.e., Development rather than development); and (4) epistemological dominance that legitimizes the first three ideologies given (e.g., epistemologies of the North).
